I saw some trip reports on WTA last week where they said there was a sign at the Mason Lake trailhead saying the same thing. I had never heard of this before. The pass isn't required year-round?
After Thanksgiving I hit Falls Creek Falls, a fairly popular hike in SW Washington. There was a note at the TH signboard noting no fee required. Although it should be noted there was a seasonal closure on the last couple miles of the road that was about to go into effect (Dec. 1).
The NWFP is only required if you use the amenities that are at the trailheads.
The Forest Service cannot charge you for:
Parking
Hiking
Backpacking
Peeing in the bushes
Crapping in a cathole
Etc
Adams vs USFS
Fragosa et al vs USFS
I saw this at the middle fork snoqualmie river trail a couple of weeks ago. The down side as others mentioned, was that the vault toilet was locked. Kind of an unfortunate surprise when we brought small kids assuming they'd have a place to "go" before or after the hike.

Do they still put a ticket on your wind shield and you have to go into the FS office and say you didn't use the outhouse to get it cancelled? If so I guess if someone values their time worth much then buying the pass would still be a financially good call.
