If you're a lawyer, you must be too far out to remember first-year torts! Palsgraf was decided based on scope of the duty, not causation. It was held that LIRR did not have a duty to prevent a harm that was too remote and unlikely to be foreseeable. Although you are correct that Palsgraf has practically zero relevance in today's legal world.

I never stated that Palsgraf is current law only that it is a classic discussion of causation and a good read to boot. In the case of bone dry forests the actual cause is the dryness of the forest and not the spark that sets it off like a package of fireworks dropped on railroad tracks. In the case of forests the cause of dryness is likely impossible to assign but the danger is readily foreseeable.

The bottle buisness is not BS, I had a deck catch on fire here a few summers ago, in August. We'd been playing in the pool with a big clear acrylic marble about 2" across. Toss it in the pool for a hide and seek game, it's real hard to see! Anyway it got left on the deck and the next day the 2PM sun on a hot day resulted in a fire starting under the marble and consuming it and about 8 feet of decking. I was *super* lucky the neighbor was out gardening and caught it, running my hose over and putting it out.

Wow, that's crazy! I'm glad it didn't burn your house down but if it had, I wonder what the fire investigators would have thought...?

Pretty good to excellent snow depths at moderate to high elevations as of this weekend. Mt. Baker hit 209" today and Paradise 200". I didn't check today but Baker yesterday reported 270" at the top of the ski area. I would imagine that above 5500-6000' north and 6500-7000' south snow depths are probably 350", enough to make a good snowman.

Thunder Basin (Comparison Plot) is now about 120% of normal. Lyman Lake is about 110%. Stevens Pass is about 130%. Harts Pass is about 125%.
