Whether or not a conviction is achieved is less important than sending a message to others that endanging highway travelers isn't acceptable. Of course the other take away is if you release an avalanche on to the highway, you sure as hell don't want to share that information with the DOT, better to slink away....

So the snowboarders cooperated with the police. Now they are getting a civil lawsuit. This does not make me want to cooperate with the police if something like this happens to me. I learn.

Affirmative. Call your attorney first, police second (if at all). And this makes me wonder, who would the prosecutor be going after if their own avalanche device(s) caused the slide that damaged their precious machines? wink.gif

Do the explosions these things create only affect conditions downslope? If CO DOT had cycled the units that morning would they have been damaged? Best.

Yes, indeed. However, I've noticed over the past 50+ years that L.E. has become blinded by $$ , and the thoughtful "Andy Taylor" style (that I recall when I was quite a bit younger) has disappeared.

The avy mitigation devices were only a year old, so wouldn't be surprised if CODOT was sill figuring out how to utilize them to their fullest potential. Not an expert, but my guess is the explosion could triggers slides above the devices.
