I checked http://www.apple.com/safari/ to confirm what I guessed, that Safari uses the Java included w/ OS X - http://www.apple.com/java/
I'm submitting a bug on this page again, which should call to Apple's attention what's been developing here.
Any chance pop up blocking would be interfering here? Powerful feature in Safari that I love and have turned on...
And if this last sentence posts then your workaround is working...
I wouldn't report it to Apple since there's custom code in the SpellChecker for almost every other browser - Safari is not listed as supported. The bug is not in SpellChecker but in the javascript (not java) "click" function which doesn't work properly in Safari. The main thing I wanted you to check is whether the submit button next to SpellCheck is working now (which from your reply it appears to be).
Anyone out there using Mozilla or Opera for OS 10.2? I'd like to hear some experiences as it's been a while since I searched for their newest betas.

BTW, Tom, I likewise do get the phpSpell window to open, but it remains empty.
